In arbitration, a dispute is referred to one or more independent third persons who act as judge and jury. The phrase "binding arbitration" means that both parties in the dispute agree to be bound by the arbitrator's decision.
Cases that are settled by arbitration are generally resolved faster than conventional lawsuits because there is less bureaucracy and court congestion is not a problem. In an arbitration, most of the technical rules of procedure followed by courts do not apply. The exceptions are that witnesses are placed under oath and written evidence can be submitted.
